TERMS OF SERVICE (TOS)
Effective date: 13 September 2025
Applies to: https://bitsellfy.com and related pages/apps that link to these Terms (“BitSellfy”, “Platform”, “we”, “our”).
These Terms incorporate our Privacy Policy. If you do not agree, do not use the Platform.
WHO WE ARE

What we do: BitSellfy is a marketplace connecting independent sellers with buyers of digital goods, including game keys, in-game items/currency, top-ups, accounts where permitted, software licenses, digital codes, and similar intangible products. Unless expressly stated on a product page, sellers are the merchants of record; BitSellfy provides the platform and related services (payments orchestration, escrow-like settlement, trust and safety, and dispute tools).
DEFINITIONS
Buyer: a user purchasing items on the Platform.
Seller: an independent merchant listing and selling items on the Platform.
Order: a purchase placed by a Buyer for a listing offered by a Seller.
System Balance (also “Account Balance”): a non-interest-bearing store of value on BitSellfy that can be used to make future purchases on the Platform. It is not a bank account, deposit, or e-money. System Balance is non-transferable and not redeemable for cash unless required by mandatory law or expressly offered by BitSellfy for a given region/method.
PSP: payment service provider (including card processors, wallets, crypto gateways).
EULA: third-party end-user license agreement (for example game/platform rules).
ELIGIBILITY AND ACCOUNTS
You must be 18+ (or 16–17 with verified parent/guardian consent) to use transactional features.
Keep your credentials confidential; you are responsible for activity under your account.
We may require KYC/AML checks (ID, selfie, address, sanctions screening). Failure or refusal may lead to limits, order cancellation, or termination.
One natural person or business equals one account unless we approve otherwise.
We may close dormant, risky, or policy-violating accounts with notice where feasible.
MARKETPLACE ROLES AND TRANSACTION STRUCTURE
Listings are created by sellers, who warrant they have the legal right to sell and that listings are accurate, lawful, and non-misleading.
Contract formation: when a buyer places an order and payment is authorized, a contract is formed between buyer and seller. BitSellfy may act as a limited agent to collect funds, apply holds, and settle payouts to sellers.
Non-circumvention: do not take BitSellfy-originated leads off-platform. We may charge avoided fees, restrict features, or suspend accounts.
WHAT’S ALLOWED AND NOT ALLOWED
Follow Category Guidelines and all applicable game/platform EULAs.
Allowed examples: legitimate keys/codes, in-game items/currency and services, accounts where permitted, software licenses, digital utilities.
Not allowed examples: stolen/unauthorized keys, counterfeit or grey content, malware/cheats, boosting that violates EULAs, illegal content, personal-data trading, or anything prohibited by law or policy.
We may remove listings, cancel orders, and withhold payouts for violations or legal risk.
PRICES, FEES, TAXES, AND INVOICES
Prices are set by sellers.
Marketplace fees: we charge sellers service fees per transaction and may charge dispute/chargeback fees; see fee schedule if available.
Taxes (including VAT): sellers are responsible for including applicable taxes in prices and issuing legally required invoices/receipts to buyers. Where we are legally obligated to withhold, collect, or remit taxes, we may do so and adjust payouts accordingly.
Records: keep accurate accounting/tax records for the legally required periods. This is responsibility of seller to take care based on their country.
PAYMENTS, CRYPTO, AND PAYOUTS
We use third-party PSPs and crypto gateways. We are not a bank, custodian, or exchange; custody and conversion are handled by integrated providers under their own terms.
Crypto specifics: crypto transactions can be irreversible and volatile; on-chain network fees, confirmations, and provider fees may affect timing and net amounts.
7.1 Refund destination (important)
Crypto-paid orders: if a refund is approved for an order originally paid in crypto, the refund will be credited to your System Balance by default.
Reason: on-chain fees, rate volatility, and security considerations can make “send-back-to-wallet” impractical or unfair.
Card/PSP-paid orders: if technically available via the PSP, refunds go to the original payment method. If that is not possible (for example method expired/closed), we will credit your System Balance.
Net value and fees: any refund reflects the net amount actually received by us after network/processor fees. Additional network/processor fees do not form part of the refund.
Compliance caveat: where mandatory law requires refunding to the same means of payment and you request it, we will make commercially reasonable efforts (subject to KYC, security checks, and technical feasibility). If not feasible, System Balance applies.
7.2 Using System Balance
System Balance can be used only to purchase eligible items on BitSellfy.
It does not bear interest, has no cash value outside the Platform, and is non-transferable. It does not expire unless required by law or we notify otherwise with reasonable notice.
7.3 Payouts to sellers
Payouts are subject to clearance windows, risk holds, compliance checks, minimum thresholds, and method availability. We may delay or freeze payouts if we suspect fraud, sanctions exposure, chargeback risk, or policy breaches.
DELIVERY AND ORDER COMPLETION (DIGITAL GOODS)
Keys/codes: delivery occurs when the key/code is revealed to the buyer on a secure page or via API.
In-game items/services: delivery occurs once items/services are transferred or performed using the method stated in the listing (for example face-to-face trade, in-game mail, in-game trading system).
Proof of delivery may include secure page logs, screenshots, on-chain transaction IDs, chat logs, and in-game confirmations.
Timeframes: sellers must deliver within the listing timeframe; if delayed, the buyer may cancel for a full refund unless the buyer agrees to wait longer.
CANCELLATIONS, REFUNDS, AND CONSUMER WITHDRAWAL (DIGITAL CONTENT)
Distance-sale 14-day withdrawal rules for consumers may apply, except that the right is typically lost for:
a) Digital keys/codes once revealed.
b) Digital services/content performed immediately after your express consent and acknowledgment that the withdrawal right is lost when performance starts or finishes.
Not delivered or not as described: open a case in the Resolution Center promptly with evidence. If the seller fails to deliver or misrepresents, we may refund the buyer and debit the seller (including fees/penalties).
Refund method: for crypto-paid orders, approved refunds are credited to System Balance (see Section 7.1). For card/PSP-paid orders, refunds go to the original method where technically available; otherwise System Balance applies. Nothing here affects your non-waivable consumer rights under mandatory law.
CHARGEBACKS AND ABUSE
Unwarranted chargebacks (for example where delivery is proven) may result in suspension, recovery of losses/fees, and denial of services. We may share fraud signals with PSPs and partners where lawful.
RISK, GAME BANS, AND NON-AFFILIATION
No affiliation: BitSellfy is not affiliated, associated, authorized, endorsed by, or in any way officially connected with any game developer, publisher, console vendor, or platform unless expressly stated. Trademarks belong to their owners.
EULA risk: buying/selling some items or accounts may breach third-party EULAs and cause account penalties or bans. You accept these risks; BitSellfy is not responsible for third-party enforcement actions or external platform availability/redemption.
AML/KYC, SANCTIONS, AND COMPLIANCE
To help prevent fraud and financial crime, we may conduct KYC, screen transactions, and block, reverse, or freeze amounts; report suspicious activity to authorities; and terminate access for sanctions or policy breaches. Provide accurate information and do not use the Platform if you are sanctioned or acting for sanctioned parties.
USER CONTENT, LISTINGS, AND IP
You grant BitSellfy a non-exclusive, worldwide, royalty-free license to host, display, and use content you submit (listing text/images) to operate and promote the Platform and your listings.
IP takedowns: send notices to [[email protected]] including item URL, your identity/authority, evidence, and a good-faith statement. We may remove or restrict content and share your notice with the seller.
REVIEWS AND COMMUNITY RULES
Reviews must be honest and about a real order. No harassment, hate speech, or doxxing. We may remove abusive or manipulated reviews and act on accounts involved in review fraud.
ACCEPTABLE USE
Do not break the law; sell prohibited items; evade fees; bypass escrow; manipulate prices or feedback; spam or phish; interfere with security; reverse-engineer; scrape private data; or access another user’s account.
SUSPENSION AND TERMINATION
We may suspend or terminate accounts (and hold payouts) for violations, legal risk, repeated chargebacks, or requests from authorities. We may retain necessary records to comply with law and prevent abuse. If feasible, we will notify you of the reason; some cases may restrict what we can disclose.
WARRANTIES, DISCLAIMERS, AND LIMITATION OF LIABILITY
The Platform is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
We do not control third-party platforms (publishers, consoles, PSPs, crypto gateways) and are not liable for their acts or omissions.
No consequential damages: to the maximum extent permitted by law, we are not liable for lost profits, lost data, or indirect/special damages.
Liability cap: our aggregate liability to you will not exceed the greater of (a) total fees you paid us in the 3 months before the event; or (b) EUR 100.
Consumer rights preserved: nothing here limits non-waivable consumer rights under mandatory law.
PRIVACY
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, share, and protect personal data, including cookie/SDK processing and your rights.
COOKIES

GOVERNING LAW AND VENUE
These Terms are governed by the laws of the Republic of Albania. Courts of Tirana shall have jurisdiction for disputes, except that consumers may bring claims in their country of residence where mandatory consumer law so requires. We encourage resolution through our Resolution Center first.
CHANGES
We may update these Terms by posting a revised version with a new effective date and, for material changes, by reasonable advance notice in-product or via email. Continued use after the effective date means you accept the changes.
